Dieses lateinische Zitat tauchte das erste Mal in den Zeiten Hadrians VI. auf, der gebeten wurde einen Mörder aus einer reichen römischen Familie zu verschonen. Er drückte mit diesem Zitat aus, dass selbst dann Gerechtigkeit geschehen solle, selbst wenn die Welt zugrunde geht. In dieser Arbeit wird die Frage aufgeworfen, ob der Europäische Gerichtshof mit der Aufnahme seiner Arbeit im Jahre 1954 sich zu einem Akteur im politischen System der Europäischen Union aufgebaut hat. Den Begriff "Akteur" definierte soziologisch Ferdinand Tönnies 1887 durch seine Willenstheorie. In dieser Schrift legte er da, dass das Handeln einer Person sich in einen kollektiven bzw., sozialen Kontext einbettet. Dies kann grundlegend definiert werden als einzelne Person (individueller Akteur) oder als Verbindung einzelner Akteure (überindividueller Akteur). Ein individueller Akteur ist der einzelne Mensch zu sehen, der durch sein Handeln einen Gemeinschaftssinn erfüllt oder seinen Selbstzweck darin sieht. Individuelle Akteure sind in heutigen politischen Systemen nur noch selten anzutreffen. Ihr Handeln richtet sich meistens auf die kommunale Ebene aus, wo eine direkte Kommunikation zwischen Akteur und Wähler stattfindet. Als Beispiele gelten hier (Orts)Bürgermeister oder Stadt- oder Gemeinderatsmitglieder. Sobald das Handeln eines Akteurs einen grö eren Rahmen bekommt, schlie en sich mehrere Akteure zusammen und bilden damit einen überindividuellen Akteur.
