Dabei verfolgt er zunächst den Werdegang der Gesellschaft bürgerlichen Rechts vom Zeitpunkt ihrer Entstehung bis zum ma geblichen BGH Urteil zur Arbeitsgemeinschaft "Wei es Ross" aus dem Jahr 2001. Anschlie end diskutiert der Autor die Reichweite der BGH Entscheidung und ihrer Auswirkungen auf die Sozietät. Hierbei wird im weiteren besonderes Augenmerk auf die Haftungsprobleme bei Altlasten nach 128, 130 HGB analog und nach 128, 28 HGB analog gelegt. Schlie lich werden die speziellen Probleme einer analogen Anwendung des 8 II PartGG auf die Sozietät sowie die Haftung von interprofessionellen Sozietäten und Scheinsozietäten beleuchtet. Abschlie end demonstriert der Autor die Vorteile einer einheitlichen Haftungsverfassung für alle rechtsfähigen Formen der GbR und spricht sich gegen eine Haftungsprivilegierung von Anwaltssozietäten aus.
