Fur die Tradition des Rechts ist - starker noch als fur andere gesellschaftliche Bereiche - die Ausgrenzung von Frauen charakteristisch. Dies gilt sowohl fur die materiel- len Inhalte gesetzten Rechts wie auch fur Recht als or- ganisierte soziale Institution. Sei es der Status der Frau als Rechtsperson, ihre allgemeine Rechtsfahigkeit, oder aber ihre Chance, "ihre Rechte" wahrzunehmen und durchzusetzen, stets war ihre Rechtsposition mehr oder weniger eingeschrankt, ihre Rechts- und Handlungsfahig- keit in die Obhut eines Mannes - des Vaters, Ehemannes oder Sohnes - gestellt, wie rechtshistorische Untersu- chungen vielfach belegen (vgl. Gerhard 1978). Die aktive Teilnahme von Frauen ihrerseits am ProzeB von Recht- setzung und Rechtfindung ist nach wie vor gering; in den Instanzen der Rechtsprechung und Strafverfolgung sind Frauen zu weniger als ein Funftel vertreten (1). Mit der Tatsache, daB Frauen auf dem Gebiet des Rechts bisher wenig Handlungs- und Partizipationsmoglichkeiten zur Verfugung standen, korrespondiert die empirische Feststellung, daB sich "Recht" als formale -wie als soziale Kategorie im AlltagsbewuBtsein von Frauen kaum wiederfindet, sie ihrgeradezu "assoziationslos" gegen- uberstehen, als hatten sie "niemals mit Recht, ver- rechtlichten Konflikten zu tun gehabt" (vgl. Klein- Schonnefeld 1978, S. 252). Begrifflich verbinden Frauen "Recht" mit "Gerechtigkeit", stellen also eher einen moralischen Bezug her. Fur Manner dagegen ist "Recht" eher eine abstrakte Kategorie - abgesetzt von der Ebene individueller Erfahrungen -, des sen generelle Bezuge - - sie in den Vordergrund ste11en (vg1. dazu ausfUhr1ich K1ein-Schonnefe1d 1978).
