Im Zusammenhang mit der "Corona-bedingten" Einrichtung von "Homeoffice"-Arbeitsplätzen ist der Arbeits- und Gesundheitsschutz ganz überwiegend auf der Strecke geblieben. Dies betrifft in erster Linie Bildschirmarbeit, die zwar in einem bestehenden Arbeitsverhältnis, nunmehr aber nicht an einem betrieblichen Arbeitsplatz, sondern zuhause, geleistet wird - häufig unter Bedingungen, die fast allen ergonomischen Gestaltungsgrundsätzen widersprechen. Obwohl für diese Arbeitsform, unabhängig davon, ob sie als "Mobile Arbeit", "Remote-Work" oder "Homeoffice" bezeichnet wird, die einschlägigen rechtlichen Bestimmungen des Arbeits- und Gesundheitsschutzes gelten - ausgenommen ist lediglich die Arbeitsstättenverordnung. Diese gilt für sämtliche betriebliche Arbeitsplätze und für die vom Arbeitgeber im häuslichen Umfeld eingerichteten "Telearbeitsplätze". Auffällig ist, dass der Begriff "Telearbeit" sorgfältig vermieden wird. Als könne dadurch die Anwendung geltenden Rechts verhindert werden. Völlig unstrittig ist jedoch, dass insbesondere das Arbeitsschutzgesetz, die Arbeitsmedizinische Vorsorgeverordnung, die Betriebssicherheitsverordnung, das Arbeitszeitgesetz, die sozialrechtlichen Bestimmungen zum Unfallschutz, das Bundesdatenschutzgesetz und das Betriebsverfassungsgesetz ohne jede Einschränkung auch für das Arbeiten von zuhause gelten. Da in absehbarer Zeit kaum zu erwarten ist, dass Aufsichtsbehörden oder Unfallversicherungsträger ihre Überprüfungspflichten erfüllen werden, wird es wohl für längere Zeit einen erheblichen Nachholbedarf beim Arbeits- und Gesundheitsschutz geben. Deshalb ist es wichtig, die für den Arbeits- und Gesundheitsschutz an "Homeoffice"-Arbeitsplätzen geltenden Vorschriften und ihre praktische Anwendung zu kennen, um möglichst schnell für eine Umsetzung Sorge zu tragen. Es geht also darum, die überwiegend oder zumindest teilweise ungeregelten Arbeitssituationen gesetzeskonform auszugestalten.
