Das vorliegende Werk stammt aus der Feder unseres verehrten Lehrers Professor Dr. Dr. h. c. HANS PETERS, den der Tod im Januar 1966 aus seiner wissenschaftlichen Arbeit herausriB. Viele seiner wissenschaftlichen Vorhaben blieben unverwirklicht. Auch sein umfangreich angelegtes Lehrbuch des Deutschen Staatsrechts, in dem er seine staatsrechtlichen Forschungsergeb- nisse und seine in vielen offentlichen Amtern gesammelten staatspolitischen Erfahrungen zusammenfassen wo11te, konnte er nicht mehr vo11enden. Er hinterlieB nur einen fragmentarischen Entwurf des Deutschen Staatsrechts. Doch offenbart dieser Entwurf, trotz seiner Unvo11standigkeit, schon deut- lich die pragende geistige Linie sowie die politisch-ethische Grundhaltung, aus denen heraus PETERS sein Werk zu gestalten beabsichtigte. Dieser Um- stand war es, der uns ermutigt hat, den Entwurf trotz seines als Lehrbuch fragmentarischen Charakters fur eine Veroffentlichung zu bearbeiten. Dabei war es unser Ziel, PETERS' Werk moglichst in seiner Eigenart zu erhalten und seinen spezifischen Zielsetzungen gerecht zu werden. Daher haben wir diesem Buch weitgehend die von PETERS selbst ganz oder doch im Ansatz bereits konzipierten Partien seines Manuskriptes zugrunde gelegt, wobei wir vorhandene Lucken des Textes geschlossen, FuBnoten eingearbeitet oder er- ganzt, Dberholtes auf den letzten Stand gebracht und an manchen Stellen, wo offensichtlich vorlaufige Formulierungen hinskizziert waren, stilistische Korrekturen angebracht haben.
