Das Problem ist allseits bekannt. Man befindet sich auf Wohnungssuche in einer gro en Stadt und sieht sich mit hohen Bewerberzahlen, vom Vermieter vorgeschriebenen Bedingungen (z.B.: keine Hunde oder Katzen, keine Instrumente) und mit Schönheitsreparaturen der alten Wohnung konfrontiert. Doch ist es nicht das Recht der Mieter, ein Tier zu halten? Müssen überhaupt Schönheitsreparaturen durchgeführt werden, wenn die Wohnung noch gut aussieht und nur 2 Jahre bewohnt wurde? Muss auf jede Forderung des Vermieters eingegangen werden, um eine Wohnung zu bekommen? Das sind alles Fragen, die sich bei der Wohnungssuche ergeben. Doch meistens wissen die Mieter überhaupt nicht, welche Rechte sie haben und welche Regelung ein Eingriff in ihre Privatautonomie ist. Um die Privatautonomie zu gewährleisten gibt es zahlreiche gesetzliche Regelungen, damit das Mächtegleichgewicht nicht ausgenutzt wird. Doch sind diese Schranken nicht auch einem Eingriffe in die Vertragsfreiheit? Um diese Fragen zu klären und was unter Eingriff in die Vertragsfreiheit zu verstehen ist, wird im wird im Folgenden zuerst geklärt, welche Vertragsfreiheiten im Zivilrecht existieren und welche grundlegenden Definitionen für das Mietvertragsrecht, speziell für den Wohnungsmietvertrag, wichtig sind. Danach wird erläutert, für welche Vertragsfreiheiten Schranken vorliegen, um den Mieter zu schützen und welche Berechtigungen sie haben. Zu letzt werden die kritischen Themen der Abwälzung von Schönheitsreparaturen auf den Mieter und das Verbot der Tierhaltung genauer betrachtet.
