Die dogmatischen Grundlagen dieser "Jahrhundertproblematik" scheinen spätestens mit der berühmten "Lüth" - Entscheidung des Bundesverfassungsgerichts gelegt worden zu sein. Aus den Grundrechten ergeben sich objektiv-rechtliche Handlungs- und Schutzpflichten, die es dem Staat gebieten, sich schützend vor die grundrechtlich verbürgten Rechtsgüter zu stellen und vor Beeinträchtigungen durch Dritte rechtlich und tatsächlich abzuschirmen. Eben diese grundrechtlichen Schutzpflichten finden ihr "zivilrechtliches Pendant" in den Tatbeständen des Deliktsrechts ( 823 ff.), das hei t die deliktsrechtlichen Normen setzen die grundrechtliche Schutzpflicht im System des Privatrechts um. Demgemä zieht sich die Grundrechtsthematik wie ein roter Faden durch das gesamte Deliktsrech. Die Wirkung der Grundrechte im Deliktsrecht soll im Folgenden schwerpunktmä ig anhand der Entwicklung des Allgemeinen Persönlichkeitsrechts auf dessen Schutzbereiche dargestellt werden. Dabei spielen auch die Kollisionen des Persönlichkeitsrechts mit gegenläufigen Grundrechten und die Entschädigung für materielle bzw. immaterielle Beeinträchtigungen sowie der postmortale Persönlichkeitsschutz eine ma gebliche Rolle.
