Die Aufspaltung der Mediendienste in Tele- und Mediendienste hat seinen Ursprung in den unterschiedlichen Gesetzgebungskompetenzen von Bund und Ländern, weil die Teledienste bundesrechtlich und die Mediendienste in den sechzehn Landesausführungsgesetzen geregelt sind. Nach bisheriger Rechtslage sind sowohl Tele- als auch Mediendienste gegenüber den Telekommunikationsdiensten sowie gegenüber dem Rundfunk abzugrenzen, da beide Gesetze für diese Bereiche keine Geltung beanspruchen. Dem Begriff des Teledienstes unterfallen nach der Regelung des 2 Abs.1 TDG alle elektronischen Informations- und Kommunikationsdienste, die für eine individuelle Nutzung von kombinierbaren Daten wie Zeichen, Bilder und Töne bestimmt sind und denen eine Übermittlung mittels Telekommunikation zugrunde liegt. Unter den Begriff des Teledienstes werden folglich alle Inhaltsangebote subsumiert, bei denen die wirtschaftliche Betätigung im Vordergrund steht, so beispielsweise bei Webseiten eines Unternehmens oder auch E-Commerce-Plattformen. Zu den Telediensten zählen folglich Internetportale mit Informations-, Kommunikations- und Transaktionsmöglichkeiten. Gleiches gilt für das Betreiben eines Meinungsportals im Internet. Zwangsläufig stellt sich deshalb die Frage, ob und wem gegenüber sich Unternehmen gegen negative Bewertungen ihrer Produkte in Meinungsforen wehren können. Auf der anderen Seite ist es für Betreiber eines Meinungsportals von existenzieller Bedeutung, ob sie für Äu erungen ihrer Nutzer haftbar sind. Der Aufsatz enthält eine umfassende Darstellung, mit welchen haftungsrechtlichen Ansprüchen der Betreiber eines Meinungsportals im Internet konfrontiert werden kann.
