Studienarbeit aus dem Jahr 2012 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Note: 11 Punkte, Christian-Albrechts-Universität Kiel (Lehrstuhl für Bürgerliches Recht, Arbeitsrecht und Wirtschaftsrecht), Sprache: Deutsch, Abstract: Der folgende Beitrag soll eine kritische Analyse der wesentlichen Kontrollinstrumente der Betriebsvereinbarung liefern, die Literatur und Rechtsprechung in den vergangenen Jahrzehnten entwickelt haben. Dabei spielt das Recht der AGB, dessen Bereichsausnahme des 310 IV 1 BGB Auswirkungen auf die gesamte Kontrolle von Betriebsvereinbarungen hat, eine beachtliche Rolle. Das Ziel, die Lösung für ein Problem zu finden, das der höchstrichterliche Recht-sprechung des BAG bis heute offensichtlich Schwierigkeiten bereitet, ist sicherlich hoch gesteckt. Es soll aber dennoch angegangen werden. Nach der Modernisierung des Schuldrechts im Jahr 2002 wurde das Recht der allgemeinen Geschäftsbedingungen, zuvor geregelt im AGBG, in das Bürgerliche Gesetzbuch aufgenommen. Dies hatte auch Auswirkungen auf das Arbeitsrecht. Gem. 310 IV 2 BGB finden seit 2002 die Vorschriften der AGB-Kontrolle - unter Berücksichtigung der arbeitsrechtlichen Besonderheiten - Anwendung auf Arbeitsverträge. Von einer Bezugnahme der AGB-rechtlichen Beschränkungen, und damit insbesondere die Inhaltskontrolle nach 307 BGB, ist indes unter Anderem die Betriebsvereinbarung dem Wortlaut nach ausgeschlossen. Dass die Rechtsprechung vor der Änderung der sog. Bereichsausnahme des 310 IV BGB dennoch Betriebsvereinbarungen teilweise intensiven Kontrollen unterzog, ist nur ein Teil der Problematik, die zur Schwierigkeit beiträgt, die Kontrolle des Inhalts von Betriebsvereinbarungen auf eine pragmatische Formel zu bringen.
