Studienarbeit aus dem Jahr 2008 im Fachbereich BWL - Recht, Note: 1,0, Bergische Universität Wuppertal, Veranstaltung: Internationales Wirtschaftsprivatrecht, Sprache: Deutsch, Abstract: Ziel dieser Arbeit ist es dem Leser einen Überblick, über die Anknüpfungsregeln im Deliktsrecht des deutschen IPR, sowie auch über die zentralen Haftungstatbestände im deutschen Deliktsrecht zu verschaffen. Aufgrund des Titels und wegen der besseren Übersichtlichkeit bietet es sich an, diese Seminararbeit in zwei Teile zu gliedern. Im ersten Teil wird das internationale deutsche Deliktsrecht im EGBGB betrachtet, denn bei einem Fall mit Auslandsbezug stellt sich immer erst die Frage welches Recht überhaupt zur Anwendung kommt. Dafür wird erst einmal der Stand der Anknüpfungsregelungen für das internationale deutsche Deliktsrecht bis zum heutigen Tag aufgezeigt. Dieser Status quo ist von einem langen Entwicklungsprozess geprägt, besonders interessant sind dabei die Änderungen nach der letzten gro en IPR Reform von 1999. Darüber hinaus soll ein kurzer Ausblick auf die wichtigsten Änderungen im internationalen deutschen Deliktsrecht gegeben werden, die ab dem 11.01.2009 durch die sog. Rom II Verordnung in Kraft treten. Im zweiten Teil werden dann die nationalen Regelungen für das Deliktsrecht im BGB betrachtet. Nach einigen Ausführungen zum Gegenstand und Begriff des Deliktsrechts, schlie t sich die Betrachtung eines allgemeinen Aufbaus einer deliktischen Haftungsnorm an. Danach werden die zentralen Grundtatbestände der Verschuldenshaftung also die 823 (1) + (2) und 826 näher erläutert, da sie die grö te Bedeutung im deutschen Deliktsrecht haben. Aufgrund der Vielzahl der Einzeltatbestände im deutschen Deliktsrecht wird nur auf den Fall der Gefährdungshaftung und der Haftung für Dritte näher eingehen, da diese noch von grö erer Bedeutung sind. Dem angeschlossen folgen dann die Regelungen zum Schadensersatz, als Rechtsfolge der Haftung aus unerlaubter Handlung. Nach einer allgemeine
