Die Mediation ist als Methode nicht auf bestimmte Bereiche beschränkt und findet mittlerweile Anwendung im Umweltrecht. Bei der Mediation versuchen die im Widerstreit stehenden Konfliktparteien unter Zuhilfenahme eines Dritten den Konflikt au ergerichtlich zulösen. Die am Verfahren beteiligten Parteien sind verantwortlich für die Ergebnisse. Die Mediation ist hierbei ein unterstützendes Hilfsmittel mit einem Verfahren und zugehörigen Methoden und Techniken zur Gesprächs- und Verhandlungsführung. In dieser Hausarbeit zum Thema Umweltmediation werden die nachfolgenden Fragestellungen bearbeitet und jede Frage in einem eigenen Kapitel bearbeitet. 1. Stellen Sie drei unterschiedliche Beispiele für Konflikte über umweltrelevante Themen zusammen. Wie werden diese Konflikte üblicherweise bearbeitet oder gelöst? 2. Definieren Sie den Begriff Mediation im Umweltbereich idealtypisch. Erläutern Sie wichtige Phasen und Prinzipien von Mediationsverfahren im Umweltbereich. Nutzen Sie zur Veranschaulichung ein Beispiel, dass Sie im Internet gefunden haben. 3. Welche zentralen Unterschiede, Vor- und Nachteile sehen Sie zwischen Um-weltmediation, Verwaltungsverfahren und Gerichtsverfahren? 4. Stellen Sie Bewertungs- bzw. Evaluationskriterien für Mediationsverfahren zu-sammen. Suchen Sie ein Mediationsverfahren im Umweltbereich, das in der Li-teratur oder im Internet beschrieben wird.
