Inhaltsangabe: Einleitung: Der Einsatz von Fremdpersonal auf der Basis von Werkverträgen im Betrieb des Werkbestellers ist zunehmend in das Zentrum der strategischen Überlegungen von Unternehmen geraten, die sich auf ihre Kernkompetenzen konzentrieren wollen. Diese Variante einer Outsourcingkonzeption begünstigt zwar eine arbeitsorganisatorische Flexibilisierung und eine Rationalisierung von Arbeitsabläufen, jedoch beeinträchtigen Konflikte als auch Koordinationsprobleme zwischen Auftraggeber und Fremdfirma die intendierten Ziele im System des Fremdpersonaleinsatzes. Die vorliegende Untersuchung soll aufzeigen, dass Abstimmungsprobleme zwischen Auftraggeber und Fremdfirma existieren und die Vorteile des Fremdpersonaleinsatzes in quantitativer, qualitativer, zeitlicher und örtlicher Hinsicht somit relativiert werden. Hierzu wird die Wirkungsweise von Koordinationsproblemen auf verschiedene Entscheidungsfelder des Personaleinsatzes nach Intensität der Einflussnahme des Auftraggebers über Kontrollinstrumente näher differenziert. Dabei tritt in dieser Arbeit insbesondere bei der Diskussion von risikokompensierenden Ma nahmen beider Werkvertragspartner deutlich hervor, dass sich der Auftraggeber den Problemen bei Fremdpersonaleinsatz aus wirtschaftlichen Gründen nicht entziehen kann. Gang der Untersuchung: Im ersten Kapitel der Arbeit wird der Begriff des werkvertraglichen Fremdpersonaleinsatzes gegenüber der Arbeitnehmerüberlassung abgegrenzt, ehe im zweiten Kapitel ausführlich auf die rechtlichen und wirtschaftlichen Rahmenbedingungen eingegangen wird. Im dritten Kapitel werden die Konfliktfelder des werkvertraglichen Fremdpersonaleinsatzes näher beleuchtet, bei denen der Auftraggeber nur einen geringen mittelbaren Einfluss auf Dispositionen über den Personaleinsatz der Fremdfirma ausübt. Als Resultat werden Lösungsansätze für Konflikte zwischen Auftraggeber und Fremdfirma diskutiert, die eine Antizipation von Risiken im System des Fremdpersonaleinsatz bezwecken.
