Die UH-RL greift auf das Haftungsregime des öffentlichen Rechts zurück und trägt dem Verursacherprinzip Rechnung: derjenige, welcher einen Umweltschaden oder die unmittelbare Gefahr eines solchen herbeiführt, wird finanziell in die Verantwortung genommen. Potentielle und tatsächliche Schädiger haften gegenüber der Allgemeinheit bereits für die Schaffung einer Gefahrenlage, welche den Eintritt eines Umweltschadens hinreichend wahrscheinlich erscheinen lässt, wenn diese auf eine bestimmte Tätigkeit iSd Anhang III der UH-RL (bzw Anhang 1 Z 1 bis 11 des B-UHG) zurückzuführen ist. Solche Tätigkeiten sind - grob umschrieben - der Betrieb von Anlagen nach dem Anlagenrecht, die (Indirekt-)Einleitung iSd WRG 1959 iVm den Abwasseremissionsverordnungen oder die Nutzung des Wassers für Herstellungsverfahren oder als Transportweg zu verstehen. Nicht umfasst sind jene Tätigkeiten, welche nicht im Zusammenhang mit oder aus dem Anlass einer Tätigkeit iSd Anhang 1 Z 1 bis 11 des B-UHG stehen. Diese Arbeit befasst sich mit den Instrumenten, die geeignet wären, als Deckungsvorsorge nach der Umwelthaftungsrichtlinie zu dienen. Au erdem werden die Kosten, welche bei Vermeidungs- und Sanierungstätigkeiten anfallen, dargestellt und die Kostentragung beleuchtet (österr. Rechtslage).
