Les fautes lucratives constituent des manquements au droit de la concurrence qui rapportent à leur auteur un bénéfice supérieur au coût lié au versement de l'amende et/ou des dommages-intérêts.

L'auteur met en évidence les incitations des agents économiques à enfreindre les règles de concurrence. Il interroge la politique de dissuasion des autorités de concurrence en soulignant les limites attachées à l'intervention de l'action publique. Il souligne par ailleurs les lacunes inhérentes à l'action privée en réparation du dommage concurrentiel. Ces limites et lacunes favorisent en pratique le développement des fautes lucratives.

L'ouvrage plaide pour la construction d'un régime dissuasif par étapes, visant à renforcer à la fois l'effectivité et l'efficacité des règles de concurrence. D'une part, afin que le droit de la concurrence s'applique effectivement, il est nécessaire de s'assurer que le contrevenant soit confronté aux coûts de sa violation. D'autre part, afin que le droit de la concurrence s'applique efficacement, il est nécessaire que le coût du manquement soit supérieur à son éventuel bénéfice.

Cette étude inédite se situe au carrefour du droit de la concurrence et du droit de la responsabilité civile.

L'ouvrage a été récompensé par le prix de thèse Concurrences ainsi que par le prix Jacques Lassier de la Ligue internationale du droit de la concurrence.
