Cet Etat est plus marqué par ses expériences historiques d'immigration que ses voisins européens et il possède une longue tradition en matière d'asile politique. Un aperçu de l'histoire d'immigration montre que la politique d'immigration ainsi que le droit d'asile en France se sont considérablement développés. De plus, les chiffres actuels de demandes d'asile indiquent que la France est encore le premier pays d'accueil en Europe et le taux d'avis positif est assez élevé par rapport à d'autres pays européens. Pourtant, il existe de nombreux problèmes concernant le respect des droits fondamentaux des demandeurs d'asile et des réfugiés. La législation leur n'est pas favorable et des exemples de cas particuliers illustrent explicitement que les demandeurs d'asile sont souvent traités de manière inhumaine. Les autorités responsables (comme le Ministère de l'Immigration, de l'Intégration, de l'Identité nationale et du Développement solidaire) semblent uniquement être capable de négliger les problèmes existants ou d'agir par des mesures sévères. De plus, la France est encore souvent nommée le pays des droits de l'Homme. Mais malheureusement, le traitement des demandeurs d'asile et des réfugiés n'est pas conforme à cette image de la France. Cependant, il y a des associations luttant contre les violations des droits de ces personnes. Ce qui montre qu'une certaine solidarité existe toujours au sein d'une partie de la population qui veut que l'on prenne au sérieux la situation des demandeurs d'asile et des réfugiés, et les considère réellement comme des victimes. Mais dans l'ensemble, il est difficile de parler encore de la France en tant que terre d'asil
