Inhaltsangabe: Problemstellung: In der gegenwärtigen Modernisierungsdiskussion der Justiz in Deutschland ist die Mediation als Instrument der Streitbeilegung zu einem zentralen Gesprächsthema geworden. Auf der Justizministerkonferenz am 25. November 2004 haben sich die Ressortverantwortlichen einstimmig auf eine Stärkung der au ergerichtlichen Streitbeilegung ebenso wie der Mediation in den Gerichten verständigt. Der Einsatz von Mediation bei Verwaltungsverfahren wird deshalb in diesem Zusammenhang in Erwägung gezogen und ihr Verhältnis zu Verwaltungsverfahren diskutiert. Das Grundanliegen dieser Arbeit bedingt Kompromisse. So ist es in diesem Rahmen weder möglich noch unbedingt erforderlich, den Stoff bis in alle theoretischen Verzweigungen abzuhandeln. Um in der vorliegenden Arbeit das Verhältnis von Mediations- und Verwaltungsverfahren sachgerecht darlegen zu können, ist es allerdings erforderlich, eine Basis für diese Ausführung zu schaffen. Deshalb wird zunächst in Kapitel I das Thema Mediation ausführlich behandelt. Im Kapitel II erfolgt dann die Erörterung des Begriffs Verwaltungsverfahren. Anschlie end werden in Abschnitt III die Möglichkeiten aufgezeigt, die eine Implementierung der Mediation in den öffentlichen Bereich zulassen. Abschnitt IV behandelt letztendlich ausführlich das Verhältnis von Mediations- und Verwaltungsverfahren und zeigt die Möglichkeiten und Perspektiven dieser Implementierung in der Zukunft auf. Mediation in der heutigen Form wurde in den sechziger und siebziger Jahren in den USA entwickelt und als Reaktion auf die überlasteten Gerichte eingeführt. Bis zum heutigen Tag gibt es keine Legaldefinition des Begriffs Mediation, obwohl sich schon seit Jahren Wissenschaftler um eine solche bemühen. Nach herrschender Meinung versteht man unter Mediation die Vermittlung in Verhandlungen durch einen neutralen Dritten, der nicht entscheidungsbefugt ist.
