Hierbei wird von einem sozialen Konflikt gesprochen, wenn eine Interaktion zwischen Individuen, Gruppen oder Organisationen und einem anderen Akteur gewisse Unvereinbarkeiten in Denken, F�hlen oder Wollen hervorruft. Bei der Verwirklichung von Elternrecht und Kindeswohl kann Mediation eine gute Alternative zur Konfliktbew�ltigung sein, wie die folgenden Seiten versuchen wollen, darzustellen. Dabei ist das Ziel der Trennungs- und Scheidungsmediation, im au ergerichtlichen Bereich zu einer fairen und f�r alle Familienmitglieder tragbaren Vereinbarung zwischen den Konfliktparteien zu gelangen. So sind Krisen der Eltern in Trennungs- und Scheidungsf�llen immer auch Krisen f�r die Kinder, da diese ihre vollst�ndige Familienstruktur verlieren. Bei Streitigkeiten zwischen den Elternteilen nach Trennung und Scheidung hat sich nach Einschaltung fremder Experten allerdings oft eine weitere Konfliktversch�rfung eingestellt, da oft genug die psychische Krisensituation der Betroffenen nicht angemessen ber�cksichtigt wird. Die allein auf justizf�rmiger Behandlung basierende Konfliktregelung wie z.B. bei familiengerichtlichen Verfahren richtet h�ufig mehr Schaden als Nutzen an und einschl�gige Forschungsergebnisse zeigen in dieser Hinsicht, dass die Qualit�t einer auf Scheidung folgenden Beziehung zwischen Eltern- Kind und auch der Elternteile untereinander keineswegs von der Qualit�t einer richterlichen Entscheidung, sondern vielmehr von den Konfliktbearbeitungsf�higkeiten der ehemaligen Partner abh�ngt.
