Das neue Schuldrecht hat auch erhebliche Auswirkungen auf das Recht der Bankgeschäfte, dort vor allem im allgemeinen Darlehensrecht, bei den Verbraucherdarlehen und Finanzierungshilfen und beim Finanzierungsleasing. Hinzu kommen eine ganze Reihe weiterer Bereiche wie Verjährungsrecht, Transparenzgebot, Banken-AGB, Zinslaufrecht und Sicherheitenverwertung. Ab Januar 2002 gilt auch das neue Recht der Überweisung.

Das Thema Wissenszurechnung bei Kreditinstituten wurde schon auf dem Bankrechtstag 1995 im Zusammenhang mit dem Zweiten Finanzmarktförderungsgesetz aufgegriffen; die Diskussion dazu in Rechtsprechung, Literatur und Öffentlichkeit ist in der Zwischenzeit rasant weitergegangen. Insbesondere die dogmatischen Streitfragen zu vielen Einzelpunkten und vor allem auch praktisch zur Reichweite der Wissenszurechnung bestehen fort - im unabhängigen und im Konzernunternehmen sowie im Zivil-, Gesellschafts- und Bankrecht.
