Dieser Satz wurde vor genau zweihundert Jahren von einem Vertreter der aufklare- rischen Philosophie geschrieben, konnte aber - gerade in seinem Idealismus - auch als prototypisch fUr die heute in der breiten Offentlichkeit wie in weiten Teilen der Wissenschaft, vor aHem der zeitgenossischen Friedens- und Konfliktforschung, vorherrschende Auffassung gelten. Nun ist die hin- ter dem "Menschlichkeits"-Pathos dieses Satzes durchscheinende Gesin- nungsethik nicht unbedingt die dominante Haltung in der praktischen Poli- tik - und dies wohl mit guten Grunden. Der von John Westlake im Eingangs- zitat beschworene "Nachteil von ganz ungewohnlicher GroBenordnung"2, der aus einer derart nach Kriterien der reinen Gesinnungsethik formulierten Regel erwuchse, wird von den Pragmatikern der Politik wie von den Anhan- gern der "realistischen" Schulen der Politikwissenschaft immer wieder be- schworen - ohne daB damit die Gegner des "Realismus" wirklich zu uber- zeugen waren. Gerade die Volkerrechtswissenschaft kann von diesem Grundlagenstreit nicht vollig verschont bleiben, wenn er sich auch in ihren Reihen nur in eher verdeckter Form auswirkt. Das Neutralitatsrecht enthalt schlieBlich seit lan- ger Zeit einen Komplex von Regeln zur Frage der Waffenlieferungen Neu- traler an kriegfuhrende Staaten. Wie der Bestand dieser Normen im Verlaufe der neueren Entwicklung des Volkerrechts verandert worden ist, bildet seit Jahrzehnten den Gegenstand einer heftigen Kontroverse.
