Eis o segundo livro oriundo dos estudos realizados no Projeto de Pesquisa O direito criminal como corpo normativo construtivo do sistema de proteção dos direitos e garantias fundamentais, nas perspectivas subjetiva e objetiva, desenvolvido na Universidade Federal do Rio Grande do Norte, sob a Coordenação Científica do Professor-Doutor Walter Nunes da Silva Júnior. O projeto de pesquisa compreende o exame do Direito Criminal como corpo normativo de proteção dos direitos fundamentais tanto na pesquisa subjetiva quanto objetiva, no escopo de investigar não apenas as decisões judiciais como a conformidade da legislação com a Constituição, o que se mostra de especial relevância, tendo em conta que o ordenamento jurídico nesse ambiente é estruturado a partir de códigos que foram promulgados para uma realidade da sociedade brasileira da metade do Século XX, um Brasil ainda marcadamente de índole rural, tentando iniciar os passos para a modernidade. Ademais, não se pode esquecer que os Códigos Penal e Processual Penal foram editados sob a égide da Constituição de 1937, a Constituição mais retrógrada da nossa história constitucional.Por isso mesmo, desde a Constituição de 1988 estamos, a um só tempo, no processo de desconstrução do modelo processual misto/inquisitivo e concomitante construção de um sistema processual arquitetado sob as bases do sistema acusatório. Não tem sido fácil, na medida em que se trata de uma questão de ordem cultural, que se apresenta como barreira para a implantação do modelo acusatório, alvitrada por sucessivas leis processuais editadas a partir da nova ordem constitucional, especialmente pela Reforma Tópica consolidada em 2008, mediante a edição das Leis n s 11.689, 11.690 e 11.719, todas de 2008, e complementada pela Lei n 11.403, de 2011.A Lei n 13.964, de 2019, denominada Pacote Anticrime, deu passo decisivo para a consolidação do sistema acusatório, sendo necessário aprofundar os estudos a seu respeito, a fim de identificar a sua importância e efetiva contribuição para a sedimentação desse movimento reformista do nosso sistema normativo criminal.O livro está dividido em sete capítulos que abordam, de forma crítica, as inovações trazidas pelo que se convencionou chamar de "Pacote Anticrime".
