Für Privatunternehmen bot sich durch diese Aktion ein Sprungbrett für ein Milliarden Geschäft. Die Regierungen konnten keinesfalls eine Einschränkung der Einsatzfähigkeit ihrer Armeen hinnehmen und mussten, bzw. konnten somit über Private Sicherheitsfirmen ihr Personal aufstocken. Insbesondere die USA, unter dem damaligen Präsident George W. Bush, erreichte hinsichtlich der Debatte über das "Outsourcing des Krieges" neue Dimensionen. Über 100 Milliarden Dollar, rund ein Fünftel der Gesamtkosten des Irakkrieges, soll die US-Regierung zwischen 2003 und 2008 für die Dienste sogenannter privater Sicherheitsfirmen ausgegeben haben. Die Einstellung von "modernen Söldnern" ist insoweit praktisch, dass Involvierte in den offiziellen Statistiken nicht geführt werden. Somit haben die Regierungen politisch einfacheres Spiel Kriege länger und intensiver zu führen, der Preis für diesen Einsatz sind jedoch Grauzonen, vor allem juristischer Art. So ist in der aktuellen Diskussion ungewiss, welche rechtlichen Konsequenzen "Söldner" wegen möglicher im Ausland begangener Verbrechen haben können. Im Laufe dieser Arbeit möchte ich der Streitfrage nachgehen, wer die Verantwortung in diesem Geschäft trägt und wieweit Verankerungen im internationalen Recht gegeben sind. Die kriegsrechtliche Behandlung von "Private Military Companies" ist dahingehend gespalten, da keine konkrete Zuteilung getroffen werden kann, ob die Auftrag gebenden Staaten von Ihrer kriegsrechtlichen Verpflichtung entbunden werden können, oder das Handeln der Privaten Ihnen noch zuzurechnen ist.
