Mit der Enquete iiber die Versorgung psychisch Kranker in der Bundesrepublik (1975) wurde eine weitgehende Reform der Psych iatrie eingeleitet. Darin wurde ein besonderes Gewicht auf die ambulante und teilstationare Behandlung gelegt. Andererseits kann auch in einem solchen System umfassender psychiatrischer Versorgung auf die geschlossene Unterbringung psychisch Kranker nicht ausnahmslos verzichtet werden. Wann aber ist eine Zwangs unterbringung, anders ausgedriickt: wann ist der Entzug der per sonlichen Freiheit unvermeidbar und unter welchen Voraussetzun gen ist er gerechtfertigt? Von Kritikem der gegenwartigen Situation wurde darauf hingewie sen, daB viele Probleme und Schwierigkeiten in der Versorgung psychisch Kranker nicht in der Psychiatrie selbst begriindet sind, sich vielmehr aus gesetzlichen Regelungen ergeben, die die Kran kenhauseinweisung psychisch Kranker gegen ihren Willen betref fen und damit ihre RechtssteHung beriihren. Die Erfahrung, daB durch offentliche Gewalt Menschen ohne Ein schaltung eines mit rechtsfOrmlichen Garantien ausgestatteten gerichtlichen Verfahrens ihrer Freiheit beraubt werden konnten, trug wesentlich dazu bei, bereits im Grundgesetz der Bundesrepu blik Deutschland, nicht nur im Grundrechtekatalog, das Grund recht auf Freiheit zu verankem, sondem dariiber hinaus eine Vor schrift aufzunehmen, durch die das MindestmaB der verfahrens maBigen Garantien festgelegt wurde. Diese Bestimmungen iiber die Mindestanforderung an das gerichtliche Priifungsverfahren blieben bis heute nicht unumstritten. Ihre Ausfiihrung wurde in Landergesetzen unterschiedlich gere gelt. Der Entzug der personlichen Freiheit ist danach zulassig zum Schutze der Offentlichen Sicherheit und Ordnung vor den von einem psychisch Kranken ausgehenden Gefahren, andererseits aus Griinden der Fiirsorge, d. h."
