Im Gegenzug setzen immer mehr private und öffentliche Organisationen, wie Google, BMW, das Auswärtige Amt oder die bayrische Landeshauptstadt München Open Source Software und Betriebssysteme in unterschiedlichsten Bereichen ihrer Geschäftsprozesse ein. In jüngster Zeit zeigen jedoch auch Schlagzeilen wie "Westerwelle beerdigt Linux" oder "München zeigt Geduld und erhöht Budget für LiMux", dass der Einsatz von quelloffenen Technologien auch problematisch sein kann. Aufgrund dieser Aktualität befasst sich die vorliegende Arbeit mit den rechtlichen und ökonomischen Aspekten bei der Entwicklung und dem Betrieb von Open Source Software. Im Blickpunkt des zweiten Kapitels stehen rechtliche Grundlagen der Open Source Software. Nach einer definitorischen Abgrenzung werden charakteristische Merkmale von Open Source Software und wesentliche Unterschiede zu anderen Softwarearten aufgezeigt. Darüber hinaus werden die gängigsten Lizenzmodelle und die damit einhergehenden rechtlichen Verpflichtungen der Anwender und Entwickler von Open Source Software erläutert. Anhand des ökonomischen Theorems der Nutzenmaximierung von Individuen wird im dritten Kapitel erläutert, welche Motivation Entwickler haben, Zeit, Arbeit und Geld in die Entwicklung von Programmen zu investieren, deren Quellcode für jedermann frei zugänglich ist. Dabei findet eine getrennte Betrachtung der Anreizfaktoren der privaten Entwicklergemeinde und der Unternehmen statt. Da
