La responsabilité médicale (RM) est régulièrement en crise. Identifiées aux Etats-Unis au milieu des année 1970, ces crises se sont répandues vers les pays développés en 1980, 1990 et 2000. D'abord présentées comme la juxtaposition de crises judiciaires et assurantielles, ces crises se sont alors révélées comme étant les conséquences de crises assurantielles, avec des périodes de très fortes dégradations de la rentabilité des marchés financiers. Mais quelle qu'en soit l'origine, la crise de la RM pose deux problématiques: l'incitation du médecin à la prévention et la compensation des victimes d'accidents médicaux. Ainsi, la RM est encadrée par des régimes de droit commun, de responsabilité civile, qui fixent les conditions d'imputabilité des responsabilités pour les médecins et les conditions d'indemnisation des victimes. A ce titre, la règles deresponsabilité pour faute, largement appliquée, et les réformes entreprises pour solutionner le dilemme incitation/compensation se sont avérées extrèmement décevantes. Dès lors, deux tentatives de résolution du dilemme sont envisagées: par une solution extracontractuelle et par une solution contractuelle.
