Dieses Lehrbuch stellt das Sachenrecht im Sinne eines gro en Lehrbuchs dar. Das bedeutet eine gründliche Auseinandersetzung mit Gesetz, Rechtsprechung und Wissenschaft. Als entscheidender Schritt der Rechtsprechung ist bei dem Thema der Berechtigung mehrerer die Anerkennung der Rechtsfähigkeit der BGB-Gesellschaft dogmatisch eingeordnet. Schlie lich sind die Bemühungen um ein einheitliches europäisches Privatrecht, soweit sie das Sachenrecht berühren, verzeichnet.

Das Anliegen des Werkes ist die systematische Erfassung des Rechtsgebiets Sachenrecht als Bestandteil des gesamten Privatrechts mit seinen verfassungs- und europarechtlichen Bezügen sowie den Fragen des räumlichen und zeitlichen Geltungsbereichs (internationales Sachenrecht, Recht der Wiedervereinigung).

Das Buch folgt in seinem Aufbau der Ordnung des BGB. Die Gesamthand des BGB ist auf der Grundlage der neuen Entwicklung eingeordnet. In der konsequenten Durcharbeitung grundlegender Einzelfälle aus der Rechtsprechung wird die genaue Erfassung des Rechtsgebiets demonstriert.

Das Buch eröffnet den Studierenden der Rechtswissenschaft den Zugang zum Sachenrecht, und es ermöglicht dem fortgeschrittenen Leser eine vertiefende Beschäftigung mit dem Sachenrecht.
