Oft ist ein winziger Technologischer Fortschritt ausschlaggebend für Gewinn oder Verlust, weshalb seinem Schutz dabei eine wichtige Bedeutung zukommt. In den siebziger Jahren entstand ein völlig neuer Technologiebereich: Die Computertechnik. Heute nehmen Software und EDV zunehmend eine wichtige Stellung in der Gesellschaft ein und das wirtschaftliche Interesse verlagert sich aufgrund der Marktsättigung im Hardwarebereich zunehmend auf die Software. Die Bereitschaft ist gestiegen, immer mehr in die Software zu investieren, da dieser als ein wesentlicher wirtschaftlicher Faktor nicht mehr aus der Gesellschaft wegzudenken ist. Im Mittelpunkt des Interesses steht daher der rechtliche Schutz von Computerprogrammen, denn Investitionen werden nur getätigt, wenn ein Gewinn erwartet wird. Der Schwerpunkt dieser wissenschaftlichen Arbeit liegt bei der Beantwortung der Frage, ob bzw. in welchen Fällen Computerprogramme patentierbar sind. Im ersten Abschnitt wird der Begriff Computerprogramm definiert, damit der Leser einen Überblick hat, welche Komponenten geschützt werden können. Danach wird untersucht, ob ein Computerprogramm im Rahmen des Urheberrechts geschützt ist und in welchen Fällen ein Patentschutz möglich ist.
