Quando da aparição deste livro, nas suas duas edições, de 2005 e 2006, publicado pela Editora Atlas, ele foi percebido como obra de referência para o estudo de um fenômeno multifacetado a que se convencionava chamar soft law.Porque ele procura focar a discussão em torno das relações entre a noção - e os fenômenos e instrumentos que ela designa - e os mecanismos de criação ou surgimento das normas do direito internacional público, o livro se tornou também obra útil para o estudo dessa ordem jurídica e, especialmente, de suas fontes.Ao apontar para a relação entre os instrumentos de soft law e a fonte costumeira do direito internacional e ao destrinchar a sua contribuição para a prática e para a opinio juris dos Estados, o livro constitui uma construção teórica de importância para a discussão sobre o direito, o não-direito e as relações entre um e outro universo.Todos esses aportes continuam atuais e, ouso dizer, demandantes de atenção. No entanto, o livro encontra-se esgotado.As referências a algo chamado soft law se multiplicaram muitas vezes desde os anos de 2005 e 2006 e as mais variadas mídias dedicadas à discussão jurídica estão repletas delas. Assim é também com a literatura acadêmica no direito. Essas referências, diferentemente deste livro, não circunscrevem a discussão ao universo do direito internacional público. No entanto, é minha impressão que algo da cacofonia que o livro identificava ainda é muito presente na discussão sobre o fenômeno e sobre o conceito. Daí ainda ser atual o convite que ele faz à precisão técnica e teórica.É verdade, também, que minha própria reflexão sobre o universo da normatividade que incide sobre todo e qualquer tipo de relação internacional avançou muito desde a publicação desta obra e que, à luz disso, inclusive a expressão soft law aparece já como genérica em excesso e como menos apta a fundar um debate em profundidade por si só.Essa reflexão, no entanto, teve neste livro sua gênese e seu ponto de partida. O que ele contém é ainda relevante e útil para estudantes e para estudiosos do direito internacional e do direito de modo geral.Para que ele possa estar disponível e acessível a quem possa ver nele essa utilidade, é que se empreende esta re-edição.
