This paper will attempt to explain the position that the state should take in the face of new trends in online communication. Undoubtedly, from the author's point of view, the new era poses the need to think about what to do with audiovisual content that is conceived and transmitted exclusively on the internet, leaving aside traditional media. This is the challenge that journalists, lawyers and states will have to face in order to ensure that one of the most important values always prevails: freedom of expression.
