La obra parte de una premisa fundamental: el derecho mar�timo no debe entenderse como un conjunto aislado de normas sobre navegaci�n, puertos, comercio, responsabilidad o seguros, sino como el resultado de procesos hist�ricos, geogr�ficos, econ�micos y estrat�gicos que han moldeado la formaci�n del derecho positivo; y �ste, a su vez, condiciona la arquitectura institucional, la pol�tica portuaria, la seguridad mar�tima, la inserci�n internacional y los l�mites reales del desarrollo mar�timo nacional.
