Este trabajo intenta llamar la atención en cuanto a esa antigua y casi olvidada figura de la equidad, al menos en términos prácticos. Nadie discute que no se haga mención sobre ella en muchos tratados de derecho; no son pocos los tratadistas y estudiosos del derecho que hagan alguna referencia a lo equitativo en alguna manera, pero en el ejercicio poco se relaciona verdaderamente para pensarse que se tiene en cuenta, que se utiliza dentro de los casos determinados que atiborran los estrados judiciales.Recientemente nuestro legislador intentó darle vida con la denominada justicia de paz (ley 497) y con los mecanismos alternativos para la solución de conflictos que se han establecido principalmente en las leyes 446 y 640, de hecho, dentro de algunos preceptos constitucionales se atisba tal espíritu vanguardista en cuanto al tema, y por todo lado se intenta afanosamente encontrar una herramienta que supla el sistema procesalista colombiano, para muchos, llamado a recoger.El autor no considera que este trabajo sea la panacea misma para la solución de conflictos en materia civil y que en forma definitiva consiga concretar las bases fundamentales para implementar un sistema que reemplace, y lo digo con todo el respeto que me merece, el ya obsoleto, agotado y agotador, procedimiento ritualista existente, solo se intenta a través de unas páginas de esforzado, minucioso y cuidadoso estudio, lanzar una inquietud al considerarse que existe una manera más idónea y ventajosa que la actual, y que los argumentos que se exponen están llamados por lo menos a sembrar un debate, que es lo verdaderamente importante.No obstante, lo anterior, sí debo confesar que guardo la esperanza que no quede este planteamiento como guardado en bolsillo roto, y que logre despertar suficiente interés en quien procure continuar la profundización y concreción de un cambio, así sea con algunas reconsideraciones, pero que conserve la intención de solucionar la grave crisis por la que está pasando nuestro ejercicio del derecho.
