Der Anregung verehrter Fachgenossen folgend, fasse ich in diesem kleinen Buch in deutscher Ubersetzung einige Aufsatze zusammen, die ich wahrend der letzten Jahre in englischer Sprache in verschiedenen Zeitschriften und Festschriften veroffentlicht habe. Die zahlreichen Knderungen und Zusatze sind nicht kenntlich gemacht. Den Aufsatzen ist das Bestreben gemeinsam, Einzelfragen des romi- schen Rechts in ihrem kultur- und ideengeschichtl, ichen Zusammenhang zu erfassen, Verbindungen mit Nachbargebieten herzustellen, sowie der Versuch, das mensch1iche Element zu erkennen, das unmittelbar oder mittelbar auf die Gestaltung des Rechts und seiner Folgen eingewirkt hat, mag es sich urn groBe Mariner handeln, etwa urn die Scaevolae, den Apostel Paulus, Chrysostomus oder Caesarius von ArIes, oder um den unbekannten "Mann von der StraBe,", wie es sich z. B. bei der Entstehung der romischen Stiftungen oder bei den Auswirkungen des ius imaginum zeigt. 1m Anhang ist eine kleine Erinnerung an den groBen Meister der romischen Geschichte angefugt.
