Dieser Vertragstypus war bereits Gegenstand einer Viel- zahl von wissenschaftlichen Untersuchungen. DaB dieses - wohlbekannte - Thema nun erneut aufgegriffen werden soli, bedarf daher auf den ersten Blick fast einer Rechtfertigung. Die jiingsten Stellungnahmen in lehre und Recht- sprechung zu diesem Fragenkreis zeigen jedoch erneut, daB tiber Rechtsnatur und Einordnung jener Vert rage nach wie vor Unsicherheit herrscht. Die in den letzten lahren bekanntgewordenen drei Schiedsspruche, welche aus AnlaB der libyschen Nationalisierung der Erdolindustrie ergingen und sich mit Konzessionsvereinbarungen zwischen Libyen und den kiagerischen aus- landischen Unternehmen zu beschaftigen hatten, deckten zusammen alle denkbaren Ergebniskombinationen ab. Die im 1 ahre 1979 gefaBte Resolu- tion des Institut de Droit international La loi du contrat dans les accords entre un Etat et une personne privee etrangere geriet, wei! man sich tiber mehr nicht einigen konnte, zu einer bloBen Beschreibung der herrschenden Vertragspraxis. Die Klarung des Stellenwerts und der Tragweite von Vereinbarungen zwi- schen Gaststaaten und fremden Investoren, bestimmte Projekte betreffend, besitzt zunachst unmittelbar-praktische Bedeutung: Von allen Seiten wird bestatigt, daB fill viele Lander auslandische Investitionen von groBer wirt- schaftlicher Bedeutung und auch nicht durch Kredite ersetzbar sind.
