Fast zehn Jahre sind vergangen, seit das BDSG geschaffen wurde. An Versuchen das Gesetz zu novellieren hat es nicht gemangelt und auch gegenwartig werden Reformvorschlage diskutiert. Die Auseinandersetzungen urn diese neuen, "geschichtslosen" Daten- schutzgesetze sind bislang jedoch gepragt von einem Mangel an empirischen Grundlagen einerseits und dogmatischer Analyse andererseits. untersuchungen wie zur (vermogensbezogenen) Com- puterkriminalitat (von Ulrich Sieber z.B.) fehlten im Bereich .der personlichkeitsbezogenen Datenschutzgesetzgebung. Fur den Bereich der Strafnormen versucht die vorliegende Arbeit hier Abhilfe zu schaffen. Sie ist die uberarbeitete Fassung einer Dissertation an der Universitat Tubingen, die dankens- werterweise bereits Aufnahme in die Datenschutz-Literatur (vgl. den Kommentar von Bergmann/Mohrle) gefunden hat. Die Arbeit basiert auf urnfangreichem empirischen Material und stellt konkrete FaIle aus der Praxis vor, womit die Datenschutz- Wirklichkeit und nicht fiktive oder spektakulare Einzelfalle Eingang in die Auseinandersetzung mit den Datenschutzgesetzen finden 50.11. Ein weiterer wesentlicher Aspekt ist die grundsatzliche Frage der Normenklarheit und Verstandlichkeit. "Moderne" Gesetze zeichnen sich zunehmend durch quantitative und strukturelle Komplexitat aus. Die Arbeit will zeigen, daB damit die Gefahr besteht an die psycho-biologischen Grenzen der Verstandlichkeit des menschlichen Gehirns zu stoBen. Es handelt sich hier urn ein grundsatzliches Problem der Konstruktion von Gesetzen und tritt nicht nur -wie hier exemplarisch dargestellt- bei den Datenschutzgesetzen sondern auch in anderen Normbereichen auf, wie dies zunehmend auch von anderen Autoren (vgl. z.B. die Dissertation von Angelika Schnell mit Beispielen aus dem Weinrecht) erkannt wird.
