Ist der Mord ein qualifizierter Totschlag oder ein selbstst ndiges Delikt? Eine der bekanntesten Kontroversen im Bereich der vors tzlichen T tungsdelikte ist, wie die beiden Straftatbest nde, der des Mordes gem 211 StGB und der des Totschlags gem 212 StGB zueinander stehen. Nach Meinung der Literatur bildet der Totschlag den Grundtatbestand der vors tzlichen T tungsdelikte. Der Mord gem stellt eine unselbstst ndige Qualifikation des Totschlags dar, w hrend 216 StGB als unselbstst ndige Privilegierung gelte, bei dessen Vorliegen der Totschlag zur cktritt. Nach Auffassung der Rechtsprechung sind die 211, 212, 216 StGB selbstst ndige unabh ngige Tatbest nde mit unterschiedlichem Unrechtsgehalt. Dem Meinungsstreit kommt dabei nicht nur lediglich dogmatische Bedeutung zu, sondern er wirkt sich bei Teilnahme an einem T tungsdelikt erheblich auf die Strafbarkeit des Teilnehmers aus. Der Mord steht als schwerstes Delikt am Anfang der Straftaten gegen das Leben. Der Mord unterscheidet sich vom Totschlag dadurch, dass letzterem keine besondere gesetzliche Verwerflichkeit anhaftet. Somit beinhaltet der Mord zwangsl ufig den Totschlag, was im Wortlaut des 212 StGB durch "ohne M rder zu sein" auch deutlich zum Ausdruck kommt. Ob man deshalb den Mord als qualifizierten Totschlag begreifen kann, ist zwischen Rechtslehre und Rechtsprechung heftig umstritten.
