Als alternative Streitbeilegungsmethode steht derzeit die Mediation verstärkt im Blickpunkt der Öffentlichkeit. Hintergrund ist insbesondere die am 21. Mai 2008 verabschiedete Richtlinie 2008/52/EG des Europäischen Parlaments über bestimmte Aspekte der Mediation in Zivil- und Handelssachen. Allerdings wird der Mediation gern ein emotionaler Touch zugeschrieben, was vielerorts zur Annahme führt, ein weltfremd angehauchter Versöhnungsgedanke solle in der Wirtschaft salonfähig gemacht werden. Carolin Adamski stellt in ihrem Buch Gerichtsverfahren und Wirtschaftsmediation als zwei Konfliktbeilegungsverfahren gegenüber und vergleicht diese miteinander. Vor- und Nachteile werden herausgearbeitet und es wird von ihr aufgezeigt, was diese beiden Modelle generell und speziell im Hinblick auf Konflikte zwischen Unternehmen leisten können. Anhand eines Beispielprozesses zwischen zwei Firmen, der durch alle Instanzen ging, wird ein Bezug zur Praxis hergestellt, verschiedene Aspekte des Zivilprozesses wie Prozesskosten und Prozessdauer werden dabei eingehend betrachtet. Von dieser Grundlage ausgehend entwickelt Carolin Adamski abschlie end ein fiktives Szenario, in dem die Mediation zur Anwendung kommt und gibt eine Einschätzung, ob Mediation in diesem Fall eine befriedigende Konfliktlösungsalternative gewesen wäre. Geschäftsleute tun gut daran, verschiedene Konfliktbearbeitungsverfahren zu kennen, um einschätzen zu können, bei welchen Gegebenheiten welches Verfahren zu bevorzugen ist.
